Wisconsin Boating While Intoxicated Laws

Wis. Stat. § 30.681 prohibits operating a motorboat while under the influence of an intoxicant to a degree that makes safe operation impossible. The standard focuses on whether alcohol or another intoxicant impaired the operator’s ability to control the boat safely. For a commercial motorboat operator, the statute also prohibits operation with a blood alcohol concentration of 0.04 percent or more.

Wisconsin boating law also includes implied consent, which means a person operating a motorboat is treated as having agreed to chemical testing under qualifying circumstances. Testing may involve a breath, blood, or urine sample. The request, collection process, and resulting analysis can therefore become important parts of the evidence.

Causing injury while operating a motorboat under the influence or with a prohibited alcohol concentration is a separate and more serious violation than intoxicated operation alone. The specific allegation and available evidence determine which issues require review.

Offense History & Boating Privilege Consequences

A first Wisconsin boating while intoxicated offense is treated as a civil matter, while second and subsequent offenses are criminal matters. Boating offenses and roadway OWI offenses, meaning operating while intoxicated, are counted separately when determining prior offenses.

An arrest can affect access to the water before the case reaches a final resolution. A BUI arrest can result in the loss of boating privileges while the matter is pending. Wisconsin doesn’t provide an occupational or restricted boating privilege option for a BUI citation, unlike the limited driving privileges that may be available in some roadway cases.

How We Review a Milwaukee Boating While Intoxicated Allegation

We begin by listening to the client’s account and examining the events that led to law enforcement contact. We consider what evidence was collected, whether officers followed the procedures governing the investigation, and which defense strategies the record may support.

Issues that may require close examination include:

  • The initial stop: The circumstances leading an officer or conservation warden to stop the motorboat.
  • Field sobriety testing: The instructions, conditions, observations, and manner in which testing was conducted.
  • Chemical testing: The request for a sample, the collection procedure, and the reported result.
  • Prior offenses: Whether earlier boating or driving matters were categorized and counted correctly.

Our DUI defense work includes reviewing the legality of stops, field sobriety testing, chemical-test results, and prior-offense calculations. Although roadway and motorboat cases aren’t identical, that experience informs our analysis of intoxication evidence without assuming the same rules apply in every setting.

A court case may involve charging decisions, negotiations, motion practice, and trial proceedings when it isn’t resolved earlier. We dedicate our resources to pursuing an appropriate resolution, whether through a plea agreement or by taking the case to court. We know the District Attorneys and Judges, and our experience gives us insight into likely outcomes in most criminal cases, but each case depends on its own facts.

Boating Enforcement on Milwaukee Waterways

Lake Michigan and the Milwaukee River are patrolled for boating while intoxicated enforcement. Milwaukee police, the U.S. Coast Guard, and the Wisconsin DNR patrol these waterways, and operating while intoxicated is a common reason Wisconsin DNR conservation wardens stop boaters.

The location and circumstances of a stop matter because enforcement contacts don’t all unfold the same way. Our review may examine which agency conducted the stop, what the officer observed, how testing occurred, and which reports or recordings document the encounter.
